Welcome to the Nymble Apps LLC! 4.2 Content Monitoring: We have the right, but not the obligation, to monitor, edit, or remove any content posted on the App Store. We do not endorse or guarantee the accuracy, reliability, or appropriateness of any user-generated content.

5) Disclaimers and Limitation of Liability

5.1 No Warranty: The App is provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

5.2 Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or exemplary damages arising out of or in connection with your use of the App. In no event shall our total liability exceed the amount you paid, if any, for accessing the App.

6) Termination

7) Free Trials

We offer free trials for certain paid subscriptions of our apps to encourage users to try our services. We reserve the right to set or change the eligibility criteria for free trials. If you do not cancel your subscription before the trial period ends, we will charge the relevant subscription fee for your selected plan using your nominated payment method.

8) Subscriptions

The subscription plans of our apps allow users to access our services and products regularly and continuously for a specific period of time.

Paid subscriptions commence on the day payment is received. Subscribers must pay recurring charges promptly to maintain their subscriptions. Failure to do so may result in a suspension of app services.

9) Billing Terms

When subscribing to our apps, users can use their Apple ID associated with their App Store account and follow the provided instructions to make purchases within the applications. By subscribing to our apps, users acknowledge and accept the following:

All outstanding payments will be charged to their Apple ID account;
Subscriptions must be cancelled at least 24 hours prior to the expiration of the current subscription period to avoid automatic renewal;
Subscription charges are made within a 24-hour timeframe before renewal;
Users can cancel or manage their subscriptions in their Apple App Store's Account Settings.

10) Refund Policy for App Store

We do not have the authority to issue refunds for in-app purchases made on the App Store. Users can contact Apple for refund requests related to in-app purchases. In-app purchases made through the App Store are automatically renewed, and no refunds are available in such cases. Users are responsible for cancelling future renewals via the App Store.

11) Governing Law and Jurisdiction

These Terms will be governed and interpreted in line with the legal regulations of the United States of America. Any legal action or proceeding arising out of or in connection with these Terms shall be exclusively brought in the state or federal courts located within the jurisdiction.

12) Miscellaneous

12.1 Entire Agreement: These Terms constitute the entire agreement between you and “Nymble Apps LLC” regarding the use of the App, superseding any prior agreements or understandings.

12.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12.3 Modifications: We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on the App Store. It is your responsibility to review the Terms periodically for any updates.
